In December 2022 the EPA amended the Clean Water Act to require local governments to inventory drainage infrastructure and keep detailed maintenance records for drainage related activities. This requirement includes maintenance records for common activities including ditch cleaning, culvert clearing/steaming, road-side mowing, snow plowing, headwall work, etc. In the aftermath of a disaster, communities must demonstrate that their facilities were regularly maintained in order to be eligible for FEMA Public assistance. Lack of detailed maintenance records and pre-disaster photographs can be a basis for FEMA funding denial.
